Wage & HourTips

Can my employer take a portion of my tips in California?

Answer

No. Under California law, employers — including managers and supervisors — cannot take any portion of employee tips or participate in tip pools. Tips belong entirely to the employees who earned them. Only non-supervisory employees may be included in a tip pool. Tip theft is a wage violation.
