Can my employer target older workers in layoffs?

No. California and federal law (ADEA) prohibit using age as a factor in layoff decisions for workers 40 and older. Employers sometimes disguise age discrimination in "reduction in force" actions by using subjective criteria that disproportionately impact older workers. If a layoff affects mostly older employees while younger ones in similar roles are retained, that may be unlawful.
