Do I have to file with the CRD before suing my employer for discrimination?

Yes. Before filing a lawsuit under FEHA, you must file an administrative complaint with the California Civil Rights Department (CRD, formerly DFEH). You have 3 years from the discriminatory act to file. The CRD will investigate and may issue a right-to-sue notice. Once you have that, you can file a lawsuit in court.
